General conditions

1. The wine bottles remain the exclusive property of Your Sommelier until the full amount is paid.

2. All our prices include 21% VAT. Prices are always per bottle or per product when indicated as such. On the volume discount tab, an additional discount is available when multiple bottles of the same wine are purchased.

3. Our deliveries/invoices are payable in cash upon delivery or collection for all our private customers and for all customers who order through the webshop. For companies and associations, deliveries or collections must be paid within a maximum of 30 days from the invoice date, but this payment extension can only be granted after our approval. Any delay in payment automatically and by operation of law, without the need for a reminder, results in the exigibility of a late payment interest at the legal interest rate plus seven percent, calculated on a daily basis, from the invoice date. Any delay of more than 31 days from the invoice date automatically results in the exigibility of a fixed penalty equal to 20% of the outstanding balance, with a minimum of €50. Each reminder or demand for payment that we send or have sent automatically results in the exigibility of a fixed sum of €12.5.

4. Complaints regarding delivery will only be accepted if sent by registered mail within 8 days from the delivery date. Complaints regarding the invoice will only be accepted if sent by registered mail within eight days from the invoice date.

5. Our wines are deliverable as long as stocks last. In case of exhaustion, you cannot claim compensation. In case of exhaustion of a vintage of a particular wine, we will deliver the next vintage produced by the relevant winemaker. 

6. Complaints regarding the conditions or quality of the wine or cork will be accepted if the relevant wine is shown to the seller and if this complaint is found justified by the seller. In that case, the buyer will be entitled to a free new bottle of wine of the same type, if available. A bottle with, for example, cork problems cannot first be consumed and then used as a complaint.

7. Orders are executed without guarantee of delivery on a fixed date. Changes or delays in deliveries on the part of the seller do not give the buyer the right to cancel the purchase or to claim compensation. In case of problems, please always contact us by phone.

8. Legislation and territorial jurisdiction: All commercial acts performed with our company fall under Belgian legislation. In case of dispute, of any kind whatsoever, only the court of Kortrijk is competent.

9. You have the right to cancel your order within 7 days. In case of cancellation of your online order, we will refund the amount paid in full, only the financial costs charged will be deducted. We do not bear these costs in case of cancellation on your part. This only applies to unopened bottles.

10. Right of withdrawal in case of delivery of products
1. When purchasing products, the consumer has the option to terminate the contract without giving any reason within fourteen days. This period starts on the day after receipt of the product by or on behalf of the consumer.
2. During this period, the consumer will handle the product and packaging with care. He will only unpack or use the product to the extent necessary to determine whether he wishes to keep the product. If he makes use of his right of withdrawal, he will return the product with all accessories supplied and - if reasonably possible - in the original condition and packaging to the entrepreneur, in accordance with the reasonable and clear instructions provided by the entrepreneur.
3. If the consumer makes use of his right of withdrawal, he will notify the entrepreneur of this within the cooling-off period by means of the standard form (see attachment 1 at the bottom of the page) for withdrawal or by any other unambiguous means.
